5th Circuit upholds judgment for officers

NEW ORLEANS – The 5th Circuit Court of Appeals on Friday upheld a $721,000 judgment against DeSoto County for firing three correctional officers in 2004.

The officers were represented by Tupelo attorneys Jim Waide, Rachel Pierce Waide and Shane McLaughlin.

Jim Waide said it’s the third time the case has been to the appeals court, with its judges ruling for the officers each time.

The case stems from the firing of Sgt. Earl Russell, and officers Tammy Williams and Cheryl Hambrick after they reported seeing another officer beat an inmate in the jail.

DeSoto County claimed they were sleeping on the job and not making proper jail checks.

Waide said it’s been “a long wait” for the officers.
