Appeal planned in Harris lawsuit

PONTOTOC – Derek Harris’ family will appeal dismissal of their lawsuit against the Pontotoc County School District and Superintendent Ken Roye.
A U.S. District Court filing Thursday indicated Derek and his mother, Phyllis, will take their case to the 5th Circuit Court of Appeals.
Their attorney, W. Brent McBride was not available to comment.
The Harrises sued Jan. 28, 2009, claiming student Derek was wrongly accused of tampering with the district’s computer system, and that Phyllis, who worked at his school, lost her job because she spoke out for him.
April 30, Judge Neal B. Biggers ruled in favor of the district and Roye, saying Derek admitted his wrongs and that when Phyllis called Roye a liar, she was justifiably fired.
