Appeals court throws out child porn conviction

JACKSON — A federal appeals court has thrown out a child pornography conviction in Mississippi after determining that it may have been the suspect’s father who used two computers to look at the images.

A Lowndes County jury convicted Keith Moreland of New Hope in 2009. The conviction was thrown out Wednesday by the 5th U.S. Circuit Court of Appeals.

The appeals court said George Moreland was dying of cancer, living with Keith Moreland and had access to his son’s computers at the time. George Moreland died in 2008, just months before his son was indicted in May of that year.

George Moreland’s other son was among witnesses whose testimony was cited by the appeals court. He testified the father asked for help destroying computers when he found out about the investigation.
