Batesville woman wins new trial

JACKSON — The state Court of Appeals has ordered a new trial for a Batesville mother convicted in 2008 in Panola County of neglecting medical attention for her injured child.

The Appeals Court on Tuesday said the trial judge in several rulings denied Amy Marie Lenard’s efforts to get the jury to heard her side of the case.

Lenard was sentenced to five years with three years in prison and two years of post-release supervision.

Prosecutors contend Lenard should have sought immediate help for her son, who is now 3, when he was severely burned by hot bath water on Oct. 26, 2007. Prosecutors say she sought medical help five days later.

Defense attorneys argued the burns had begun as sunburn-like injuries and the condition worsened over five days when Lenard applied an over-the-counter ointment.
