City: Missing ex-officer should end stun-gun case

JACKSON, Miss. (AP) — The city of Jackson says a federal judge should dismiss a lawsuit claiming that 21-year-old Rafael Forbes was killed in 2007 by a Jackson policeman’s stun gun, because the officer who used the stun gun cannot be found.

The Clarion-Ledger reports that Patricia Forbes’ lawsuit has languished partly because former officer Joe Nicholas Brown has never been subpoenaed.

In a response to the city’s request, attorney Ellie Turnage says Forbes and her attorneys have done all they can to find Brown, but neither Forbes nor the police department has any information leading to his whereabouts.

The city says an autopsy showed he died as a result of hypertensive heart disease, morbid obesity and hyperthermia.
