Clay circuit court to hear appeal

WEST POINT — A Clay County woman found guilty of negligence and fined $50 for running over a Starkville bicyclist last year has appealed.

The Daily Times Leader reports, the case is scheduled to be heard April 2 in Clay County Circuit Court.

Robbie Norton of Cedar Bluff was found guilty in November in justice court.

Jan Morgan filed charges of simple assault with a deadly weapon against Norton. Morgan was struck while she and a friend biked along Mississippi Highway 50 in western Clay County last May.

Justice Court Judge Joe Taggart opted for a guilty verdict on a misdemeanor charge of negligent driving.

Prosecutors said at the time Norton broke no laws and that it was an accident but Morgan said she wanted safety for cyclists.

Norton’s Marty Haub said there is no evidence that Norton actually committed an act of negligence and simple assault.

“All we have here is a traffic accident, a terrible accident with horrible injuries, yes, but an accident nonetheless,” Haub said at the November trial. “It’s regrettable, but punishing someone criminally for a traffic accident is not lawful.”
