JACKSON, Miss. (AP) — The Mississippi Supreme Court won’t hear an appeal from a DeSoto County man who claimed his guilty plea was involuntary.
Richard Wayne Partain pleaded guilty in 2008 to manslaughter by culpable negligence. He was sentenced to 15 years in prison. His post-conviction petition was denied in 2010. The state Court of Appeals ruled against Partain last year.
Prosecutors say Partain’s negligence led to the death of 92-year-old Lillian Esery after a car crash on Oct. 28, 2007, in Southaven. Prosecutors say a test later showed Partain’s blood-alcohol level was above the legal limit.
Partain alleged his Southaven lawyer failed to explain to him the consequences of pleading guilty. The Appeals Court said court records show the trial judge and prosecutors completely and adequately explained the details of the case and the penalties.
