OXFORD – Former Mississippi Highway Patrol Director Mike Berthay is asking U.S. District Judge Glen Davidson to dismiss him from a suit that alleges his former employee, ex-trooper Christopher Hughes, used excessive force while on duty as a law enforcement officer.

Berthay claims any disciplinary action taken against Hughes should have been taken at a much lower rank than his and that the videotape of Hughes beating a suspect never reached his desk.

The motion for summary judgment was filed Tuesday afternoon.

No Bubba, that’s not the way it works. You were the boss, the commander and as such it occurred on your watch. No ducking what is clearly part of your job description.
