Fulton man faces child porn charges

What initially began as a drug paraphernalia arrest has resulted in charges of child pornography for a Fulton man.

Jeffrey D. Smith, 32, of 6599 Van Buren Road was arrested on Sunday and charged with possession of paraphernalia, according to Itawamba County Sheriff Chris Dickinson. During an investigation of Smith’s residence, investigators allegedly discovered a collection of child pornography on the suspect’s computer and cell phone.

Smith was charged with child pornography Wednesday afternoon.

Although Smith has been charged, the number of counts he will face is still being determined. Investigators say they are currently mining the contents of Smith’s computer and phone to determine the number of counts with which to charge him.

In cases of child pornography, a suspect can be charged for each individual photograph or video, although not two instances of that same piece of evidence. For example, a suspect with four pornographic photos can be charged with four separate counts of child pornography. But, if that same suspect has one photo in four locations, than he would only receive a single charge.

Each count of child pornography carries a maximum sentence of 20 years, and/or $50,000 fine.
