Judge dismisses age discrimination suit

CORINTH, Miss. (AP) — A federal judge has dismissed with prejudice former Corinth building inspector Junior Morgan’s age discrimination lawsuit against the city.

The Daily Corinthian reports Morgan, who served as building inspector from 1995 until his termination in January 2008, sought actual and liquidated damages and reinstatement to his job.

U.S District Court Chief Judge Michael P. Mills, in an order issued last week, granted the city of Corinth’s motion for summary judgment in the Age Discrimination Employment Act case.

The judge’s order states that “no genuine issues of material fact exist regarding plaintiff’s ADEA claims.”

Morgan’s lawsuit claimed the Board of Aldermen had expressed a desire that he retire upon reaching age 65, but he declined to retire at 65, resulting in his termination.
