Lawsuit filed against Aberdeen school board

ABERDEEN – In a lawsuit filed Tuesday in U.S. Northern District Court in Aberdeen, three plaintiffs are suing the Aberdeen School Board and Aberdeen School District Superintendent Chester Leigh.
The plaintiffs’ complaint states they were denied absentee voting privileges in Saturday’s upcoming school board election.
Ruby Cunningham, Willie H. McNairy and Ladie M. James claim they are elderly, disabled or an hourly worker and that these conditions will prohibit them from voting in the school board election.
The plaintiffs allege they were denied absentee ballots by Leigh. The complaint states Leigh said absentee voting is prohibited in the election. According to the complaint, there are no provisions set fourth for absentee voting in school board elections.
Wilbur Colom, attorney for the plaintiffs, states this is unconstitutional via the complaint.
