Lundy requests bail on conviction appeal

OXFORD – Damion Lundy wants to stay free on bond while he appeals his conviction for enticement of a minor girl for sex.
Lundy, 28, of Hollandale was convicted by a federal jury in July on a 2006 case arising from a Lee County Sheriff’s Office sting operation using the Internet.
He is due to turn himself in to a Texas prison Jan. 31 to serve 10 years.
Filed late Tuesday, his appeal reminds the court that he has no prior convictions as well as strong family ties in Mississippi.
Lundy’s appeal to the Fifth Circuit will include a claim his trial judge committed reversible error by excluding testimony from his proposed expert witness because his trial lawyer missed a court deadline to submit the name.
