Miss. Supreme Court won't hear appeal in Alcorn County case

JACKSON — The Mississippi Supreme Court will not hear an appeal from a man convicted of burglary and aggravated assault in Alcorn County.

Timmy Dale Whitaker was convicted in 2010. He was sentenced to 25 years without parole for burglary and 20 years for aggravated assault.

The Appeals Court upheld his conviction in last year. The Supreme Court this past week denied a request to hear the case.

Authorities say Whitaker drove two men to the home of William Clark in August of 2008 and dropped them off. Court records show the men broke into Clark’s home and beat him with a crowbar before taking money from him. Whitaker later picked the men up.

Whitaker argued that he was hospitalized and had taken drugs when he confessed to investigators.
