NEW ALBANY – Robert Smithey Jr., 28, of County Road 172, was charged Monday with depraved-heart murder after he allegedly killed a 20-year-old friend.
Nathan Dunson, 20, was shot in the face with what was believed to be a .45-caliber semiautomatic pistol shortly after he and his wife arrived at Smithey’s house for a visit Saturday night.
Smithey reportedly shot Dunson from outside through a window in the house, claiming he didn’t know the gun was loaded.
“The stories are inconsistent with what the crime scene shows us,” Sheriff Tommy Wilhite said. “The investigation is still continuing, but we decided to go ahead and charge him and let the grand jury decide.”
Depraved-heart murder denotes a lack of premeditation but that displays a reckless disregard for human life.
Smithey remains in the Union County Jail in lieu of $500,000 bond.
