State wants dismissal from beating case

OXFORD – The Mississippi Attorney General’s Office is asking the Commission of Public Safety for the state of Mississippi be removed as defendant and cross defendant in the federal suit alleging former Highway Patrol Trooper Christopher Hughes used excessive force while on duty as a law enforcement officer.

The motion claims the Commissioner of Public Safety, Albert Santa Cruz, is protected from the suit by the 11th Amendment of the United States Constitution.

The motion to dismiss claims against the commission was filed Wednesday.
