ABERDEEN – Biofuels entrepreneur Tommy Tacker of Okolona on Wednesday appealed his fraud conviction to the Fifth Circuit Court of Appeals.
Earlier this month, Senior U.S. District Judge Glen H. Davidson denied his motions for a new trial and to reconsider the jury’s guilty verdict.
Last February, a federal jury convicted Tacker on 10 counts of defrauding the U.S. Department of Agriculture of nearly $3 million in a biofuels subsidy program.
Tacker built a biodiesel refinery in Nettleton but it went bankrupt in 2006.
He faces paying restitution and a five-year prison term.
