Trial in Hattiesburg election? Ruling Monday

HATTIESBURG, Miss. (AP) — Trial is scheduled this week in a challenge to the June 24 election for mayor of Hattiesburg.

A specially appointed judge will decide Monday whether the trial will open Tuesday.

Last week, Mayor Johnny DuPree asked Judge William Coleman to dismiss former city council member Dave Ware’s claims of voter irregularity. DuPree’s lawyers contend that — even if the challenged votes are struck out — DuPree would still have a four-vote margin.

The official tally gave him a 37-vote victory.

The Hattiesburg American (http://hatne.ws/12Z0Las) reports that a hearing is scheduled at 2 p.m. Monday. If Coleman rejects DuPree’s motion, the trial will begin at 10:30 a.m. Tuesday.
