UPDATE: Attorney Tharp says he'll appeal simple assault conviction

3:54 P.M. – Attorney Kirk Tharp says he will appeal his conviction Monday on a misdemeanor simple assault charge in Lee County Justice Court.

TUPELO – Attorney Kirk Tharp was found guilty and fined $290 today on a simple assault charge in Lee County Justice Court.
Judge Sadie Holland issued her ruling late this morning.
She reportedly did not order any jail time for her verdict after a 3 1/2 hour hearing Thursday.
Through a text message to the Daily Journal, Tharp said he and his attorney will issue a statement.
Tharp also serves as Sherman’s prosecuting attorney and Mantachie’s municipal judge.
Both mayors said they will inform their boards of the court decision.
Sherman Mayor Ben Logan said his board will take the matter up in executive session Tuesday night.
Mantachie Mayor Jeff Butler said, “It won’t make no difference.”
Teenager Kurtis Yarbrough filed the assault charge after a Sept. 10 incident at Mooreville One-Stop, where the former ICC student claims Tharp attacked him, injured him and broke at least one of his two hearing aids.
Tharp insisted he responded to verbal threats he heard coming from Yarbrough’s vehicle parked behind him at the gas pumps that morning.
