UPDATE: Burns' clemency appeal pending

PARCHMAN — Death row inmate Joseph Daniel Burns was scheduled to be moved to a holding cell at the state prison in Parchman on Monday to await his scheduled execution now set for 6 p.m. Wednesday.

Burns attorney filed a clemency request with the governor’s office, seeking a delay so Burns can get a mental evaluation. The governor’s office told The Clarion-Ledger that Gov. Haley Barbour will consider the request. Barbour has never granted such a request.

The Mississippi Supreme Court denied the request last week.

Burns, now 42, was convicted in 1996 of the stabbing death of Tupelo motel manager Floyd Melvin McBride two years earlier.
