UPDATE: Judge declines to dismiss Hardy's case v. Tupelo

TUPELO – Former Tupelo Police Capt. Cliff Hardy will get his day in court, U.S. District Judge Sharion Aycock ordered today.

Earlier this week, attorneys for the City of Tupelo argued Aycock should dismiss Hardy’s lawsuit filed in the Northern District of Mississippi.

Aycock’s ruling came a full week before she said she would do so.

But today, she validated Hardy’s July 20 trial date in Aberdeen.

Hardy claims he was virtually fired after a series of demotions put him in menial jobs for TPD, and he subsequently retired. He insists these demotions were based on a public speech he gave in October 2006 about racial bias in the department.
