West Point asks judge to dismiss lawsuit

WEST POINT — West Point officials have asked a federal judge to dismiss a wrongful termination suit filed by Shasta Plunkett, who alleges he was removed by the city’s majority black governing board as interim head of the city’s electric department because he is white.

The Daily Leader reports that the city argues in court papers that Plunkett should have sought administrative remedies before filing a lawsuit.

Records show Plunkett was demoted in February 2010 as the department’s interim superintendent and given a job as an adviser to the city’s chief administrative officer. He was fired in April 2010, records show.

The city’s says Plunkett’s predecessor was white as was his successor. The city says Plunkett has no grounds for a racial discrimination claim.
