Today, Senior U.S. District Judge Neal Biggers Jr. granted the former Oxford attorney a hearing set for 10 a.m., even to present evidence to support a motion filed with the court last fall.
In early 2008, Scruggs pleaded guilty to not reporting that he knew an illegal conversation was held between then-New Albany attorney Timothy Balducci and then-Circuit Judge Henry Lackey of Calhoun City about sending a legal-fees lawsuit to arbitration.
The lawsuit, Jones v. Scruggs, claimed Zach's father, Richard "Dickie" Scruggs, and others involved with Hurricane Katrina insurance litigation still owed fees to Jackson attorney Johnny Jones.
In his 2010 motion, Zach insists that he was pressured into pleading guilty, when he was innocent, and even then, what he pleaded guilty to is not a crime.
