Nothing major to report, but I need to catch y'all up on the latest in the Forrest Moore/John Cohen lawsuit. Cohen filed a motion to dismiss on June 10, and now the other named individual defendant, Mike Nemeth, has filed his own motion to dismiss (dated July 20, Oktibbeha County Circuit Court).
Nemeth, MSU's associate athletics director for media relations, denies all the accusations made against him by Moore. It boils down to this: Nemeth denies Moore was not provided proper written notification that his scholarship being renewed, because as Nemeth's motion states, "his financial aid award was not terminated."
Moore's contention is that he was forced to accept a permanent medical scholarship instead of his normal scholarship, thus ending his college career. Cohen and Nemeth both deny this allegation.
Nemeth denies that Moore is entitled to any sort of damages, and the motion says, "At all times, Nemeth acted in good faith."
Nemeth claims immunity from Moore's allegations, citing the Mississippi Tort Claims Act, and says he was "acting within the course and scope of his employment" with MSU.
Also, Nemeth says he was not properly served notice of Moore's complaint and the summons, which were given to someone else at his office.
