Djournal.com attempts to provide you with the best resources on North Mississippi as well as an engaging community to share your thoughts, beliefs and concerns.  Every successful community has rules that must be followed in order to benefit the greatest number of persons; and we are no exception.  Using djournal.com requires that you as a member or a visitor abide by those respective rules.

User Agreement (Visitors)

By using the Djournal.com web site ("Djournal.com"), you hereby agree to be bound by all of the terms and conditions contained in this User Agreement ("Agreement").  Djournal.com reserves the right at its discretion to change the terms of this Agreement and will notify users of any such changes by online postings.  Your continued use of Djournal.com after the posting of any such notices will constitute your acceptance to be bound by any such changes.

Copyright and Restrictions: All information displayed, transmitted on carried on Djournal.com (including, but not limited to news articles, guides, opinions, reviews, photographs, images, illustrations, multimedia clips and trademarks; collectively the "Content") is protected by copyright and other intellectual property laws.  The Content is owned by Journal Publishing, Inc., it's affiliates, advertisers or other third party licensors.  You may not modify, publish, transmit, transfer, sell, reproduce, create derivative works from, distribute, repost, perform, display or in any way exploit any of the Content or infringe upon trademarks contained in the Content.  You agree to abide by all copyright notices and restrictions attached to any content accessed through Djournal.com, not to alter the Content in any way and not to remove any trademark, copyright or other notices from copies of the Content.

Permitted Use. You may make a single copy of the Content displayed on Djournal.com for personal, noncommercial use only, provided that you do not remove any trademarks, copyright or other notices contained in the Content. You shall not archive or retain any Content in any form without the written permission from Journal Publishing, Inc.. You may not distribute (including via e-mail or the Internet), or otherwise make available, copies to others, whether or not for payment or other consideration, without the written permission from Journal Publishing, Inc.. You may submit requests for permission to retain, distribute or reproduce to Djournal.com.

Changes on Djournal.com: Journal Publishing, Inc. may modify, suspend, discontinue or restrict the use of any portion of Djournal.com, including the availability of any Content or feature, at any time and without notice or liability.

Content Disclaimer and Limitation of Liability:  Djournal.com contains facts, opinions, statements and recommendations of third party individuals, organizations and institutions.  Djournal.com does not represent or endorse the accuracy, timeliness or reliability of any advice, opinion, statement or other information displayed on Djournal.com.  You acknowledge that any reliance on any such advice, opinion, statement or other information will be at your sole risk.  No warranty regarding Djournal.com or any Content, services or products provided through or in connection with Djournal.com is made.  Journal Publishing, Inc. expressly disclaims any and all warranties, express or implied, including but not limited to warranties as to the availability, accuracy, completeness or content of Content, products or services which are a part of Djournal.com and warranties of fitness for a particular purpose or merchantability or against infringement. In no event will Journal Publishing, Inc., its affiliates, advertisers, licensors, employees agents or contractors be liable to you for any damages or losses, including but not limited to consequential, special, incidental or punitive damages resulting from or caused by Djournal.com, its public postings, its content or any errors or omissions in its content, even if advised of the possibility of such damages.

This agreement will be governed by and construed in accordance with the laws of the state of Mississippi, without regard to its conflict of law provisions.  Any cause of action with respect to this Agreement and your rights and obligations must be filed in the County of Lee, State of Mississippi within one year after the cause of action, otherwise the cause shall be barred.

Member Agreement 

By enrolling in Djournal.com ("Account"), you hereby agree to be bound by all of the terms and conditions contained in this Member Agreement ("Agreement"). Establishing an Account with Djournal.com under a name other than your own legal name is prohibited. Djournal.com reserves the right at its discretion to change the terms of this Agreement and will notify you of any such changes by e-mail or online postings. Your continued use of your Account after the posting of any notice of change in terms constitutes your acceptance to be bound by any such changes. You may cancel your Account should any specific change be unacceptable to you.

Member Information: You agree that Djournal.com may use the information provided by you as part of the registration process for its own business purposes and may provide statistical information associated with Djournal.com members to potential advertisers for the use of Journal Publishing, Inc.; provided, however, only Djournal.com shall receive your individual and personal identifying information. Journal Publishing, Inc. will not sell member lists which include your personal information to third parties for direct marketing purposes, unless you have authorized Journal Publishing, Inc. to do so. Your information is subject to verification by telephone or electronic mail.

Copyright, Restrictions, Content and Liability:  You agree to be bound by all terms of the User Agreement  and to abide by all notices of the same as posted on Djournal.com.

Non Transferable Account: Access for the areas requiring registration on Djournal.com is intended for members only.  You may not resell, transfer or assign your Account or allow others to access it in whole or in part, or otherwise exploit the terms of your membership.

Submissions and Public Postings: You agree not to use Djournal.com or permit your account to be used to send or submit for public or private posting any content (textual, graphical, linked or otherwise) which is:

• Libelous, abusive, obscene, profane, defamatory, inaccurate, sexually explicit, threatening or otherwise illegal
• Promotes, suggest or encourages illegal acts
• Contains expressions of bigotry, racism or hate
• Contains any solicitation of funds or unsolicited mail
• Violates any copyright, trademark or other intellectual property laws
• Contains the advertisement of goods or services, except in areas specifically designated for such a purpose

Any violation of these prohibitions may result in the termination of your account and may be referred to Law Enforcement authorities.  Djournal.com is not responsible for any content submitted by users or through their respective member accounts, or for screening, editing or monitoring such material.  Djournal.com reserves the right (but is not obligated) to delete content that it, in its sole discretion, deems to be in violation of the terms of this Agreement or to be otherwise unacceptable.  You assume full responsibility for all content posted by you or through your Account.

By submitting materials to a public posting area, you represent that such materials are your own ideas and work product and are not in violation of copyright, trademark or other such agreements.  You hereby irrevocably grant to Djournal.com permission to use all or parts of your submissions as if it were in the public domain, including modifying it or using it commercially.

You agree to indemnify, defend and hold Djournal.com and all of its affiliates harmless from any claims, including but not limited to claims for defamation, trade disparagement, privacy and intellectual property infringement, and damages including attorneys' fees arising from any submissions by you or through your account.

Fees and Payments: You agree to pay all charges incurred on your Account, including charges, surcharges, taxes or fees for use of Djournal.com as well as charges for any merchandise or services added to your Account.  Illegal, fraudulent or abusive use of an account is grounds for termination of such account and may be referred to Law Enforcement authorities.  While Djournal.com will make efforts to protect your credit card information, the nature of the Internet is such that any information you send could be viewed while in transit.  Journal Publishing, Inc. will not be liable for any amounts billed to your credit card by a third party which were not authorized by you.

Term and Termination: Your account will continue until terminated by either Djournal.com or you.  Djournal.com may terminate your account at any time without cause.  Notice of termination is the only remedy afforded members dissatisfied with Content, services or changes in policies, terms of this Agreement or fees related to Djournal.com.
