Special Circuit Judge Vernon Cotten set a Nov. 21 trial date in Alcorn County in the election challenge brought by Steve Hill. Cotten and Corinth election commissioners will jointly hear the case.
Steve Hill was the incumbent Ward 4 alderman when he lost the Sept. 28, 2010, Democratic primary runoff to J.C. Hill by two votes. He later filed a challenge to the election results, saying that as many as 16 voters in the ward election were not actually residents of the ward.
Cotten, of Leake County, last month denied the motion by Steve Hill's attorney, Danny Lowrey, for a summary judgment in his client's favor. Cotten is hearing the case after local judges recused themselves.
Since January when Cotten held the first hearing in the case, the two sides have been able to examine the ballot box and ballots in question, obtain documents in discovery and depose witnesses.
After his motion for summary judgment was denied, Lowrey filed a motion for trial.
