The Clarion-Ledger reports that Patricia Forbes' lawsuit has languished partly because former officer Joe Nicholas Brown has never been subpoenaed.
In a response to the city's request, attorney Ellie Turnage says Forbes and her attorneys have done all they can to find Brown, but neither Forbes nor the police department has any information leading to his whereabouts.
The city says an autopsy showed he died as a result of hypertensive heart disease, morbid obesity and hyperthermia.
