5th Circuit denies new Scruggs appeal

NEW ORLEANS – Zach Scruggs’ 2008 conviction appeal will not be heard by the full 5th Circuit Court of Appeals.

In a two-page, check-box notice dated Oct. 1, the court said his petition for full hearing was denied and that no member asked that the issue be voted on by the court’s judges.

Scruggs, a former Oxford attorney, seeks to have his conviction and sentence vacated for his guilty plea to knowing but not reporting that a colleague had an illegal conversation with Judge Henry Lackey over a lawsuit he presided over.

Scruggs, his famous litigator father, Richard “Dickie” Scruggs, and three others were indicted for attempting to bribe Lackey, but Zach Scruggs ultimately pleaded to a lesser charge.

They all went to prison and only Dickie Scruggs remains to serve time for this and another guilty plea.
