Last week, the Mississippi Motor Vehicle Commission levied a $10,000 fine against Carlock Nissan in Tupelo, accusing the dealership of violating Regulation Four, which deals with deceptive or misleading vehicle advertising
Carlock said he doesn’t know what the exact charge is, but said he does know what it involves.
“We sent out a mailer similar to what three or four other dealers around here have done,” he said. “We even had one sent to the commission and we were told all we needed to do was to move some of the disclaimers under the photos.”

But the next thing Carlock heard from the commission was that a complaint had been filed against his Nissan dealership. Carlock said he was notified of a commission meeting “three or four days” in advance but was already committed to another event and could not attend.
“We get hit with a $10,000 fine, and we really don’t know what part of Regulation Four that we supposedly violated.”
Carlock has until Oct. 18 to appeal the fine, and he said a company attorney was looking into the commission’s ruling before deciding whether an appeal would be filed.
Chuck Nelms, executive director of the MMVC, last week said a complaint was filed against Carlock Nissan and that it could have been filed by either a customer, another auto dealership or by an automobile manufacturer.
An investigation was conducted and “we felt there was a violation” of Regulation Four, Nelms said.
Carlock said he thinks another dealership filed the complaint.
“I know it wasn’t a customer,” he said.
