ABERDEEN – William T. “Tommy” Tacker II asks the U.S. District Court to move his fraud trial because publicity has hurt his chances for a fair trial, his attorney says in a newly filed document.

Tacker of Aberdeen is set for a Feb. 22 trial on multiple counts that he and co-defendant H. Max Speight of Tennessee defrauded the U.S. Department of Agriculture in a biofuels subsidy program.

The pretrial publicity surrounding the case has been “pervasive” and “adverse,” the motion states.

New trial site choices, writes attorney Robert W. Davis Jr. of Tupelo, could be to another federal court district or to another division within the Northern District outside the readership area of the Northeast Mississippi Daily Journal.
