John Chrestman was assistant Smithville principal when the lawsuit was filed, but he has since died.
Attorney Mitchell Driskell of Oxford tells the court in a motion filed Wednesday that because the man suing failed to serve mandatory paperwork on Chrestman within a 120-day time frame, he should be dismissed as a defendant.
The man suing was a minor when he claims Bowling molested him. He also claims officials with the school district knew about the coach’s actions but failed to do anything about it.
The defendants deny the allegations.
