Appeals Court denies rehearing in Alcorn County burglary case

JACKSON — The state Court of Appeals will not rehear the case of a man charged with burglary and aggravated assault in Alcorn County.

Timmy Dale Whitaker was convicted in 2010. He was sentenced to 25 years without parole for burglary and 20 years for aggravated assault.

The Appeals Court upheld his conviction in last year.

Authorities say Whitaker drove two men to the home of William Clark in August of 2008 and dropped them off. Court records show the men broke into Clark's home and beat him with a crowbar before taking money from him.

Prosecutors say Whitaker returned and picked the men up.

Authorities say Whitaker gave a confession to investigators while in the hospital but Whitaker argued he was under the influence of narcotics when the made the confession.
