Shoemaker’s attorneys asked the appeals court to allow him to remain free on bond until the New Orleans court looks at his recent convictions in a Batesville hospital kickback-bribery case.
Late Wednesday, 5th Circuit Court of Appeals Judge Leslie Southwick granted a halt to his surrender until certain bond issues are addressed.
Earlier that day, Senior U.S. District Judge Neal B. Biggers Jr., who presided over Shoemaker’s trial, denied his bond request.
But 2:30 p.m. Friday, Southwick issued a one-page order denying the bail request and Biggers ordered the new surrender date.
Shoemaker insists he is not guilty of the crimes he was convicted and asks the 5th Circuit to overturn them and his sentence.
